These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with services provided by Northern Virginia Ponds LLC (referred to as "us", "we", or "our"). Please read these Terms and Conditions carefully before using our Service.

1. Agreement to Terms

By accessing or using our Service, you agree to be bound by these Terms.

2. Service Description

Our Service involves pond installation, removal, cleaning, and maintenance services as described on our website or as agreed upon with the customer.

3. Liability Disclaimer

We always strive to provide high-quality services and take the utmost care; however, we cannot guarantee the health or safety of fish or other aquatic life during pond-related services. By using our Service, you acknowledge that there are inherent risks involved, and we shall not be liable for any harm, injury, or death of fish or other aquatic life that may occur.

4. Cancellation Policy

We require at least 48 hours’ notice for cancellations or rescheduling of appointments.

Cancellation Fee:

• Cancellations made less than 48 hours but more than 24 hours before the scheduled appointment will incur a fee of 25% of the service cost.

• Cancellations made within 24 hours of the scheduled appointment will incur a fee of 50% of the service cost.

Rescheduling Fee:

• No fee applies if at least 24 hours’ notice is given.

• Requests to reschedule within 24 hours of the service time will be subject to a 10% fee.

Contact us by phone at (571) 579-1886 or email at info@novaponds.com. Cancellations via voicemail, email, or text message are acceptable if made within the required timeframe.

Emergency Situations:
We understand emergencies may arise. At our discretion, cancellation fees may be waived in genuine emergency cases.

5. Payment Terms

Payment is due when the invoice is provided, unless otherwise agreed upon in writing.
Invoices not paid within the agreed timeframe will incur a late fee of 20% of the total invoice amount.
Customers are responsible for any collection costs, including reasonable attorney fees, associated with unpaid invoices.

6. Modifications

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to new terms taking effect.

Pond Cleaning–Specific Terms

8. Excessive Debris Disclaimer

Cleaning service estimates are based on photos and information provided in advance. If, upon arrival, the pond is found to contain substantially more debris, sludge, or organic waste than reasonably expected, we reserve the right to adjust the final price to reflect the additional labor and disposal required.

9. Disposal of Organic Waste

Unless otherwise agreed, we assume we may dispose of organic waste from cleanings (such as leaves, sludge, and algae) on site in designated areas (woods, compost piles, or natural drainage). If the volume of debris is excessive, or the client does not allow on-site disposal, additional disposal fees may be incurred to cover removal and transportation off-site.
